Membership Terms and Conditions.
PLEASE READ THE TERMS AND CONDITIONS OF THIS CONTRACT
By signing our agreement you are confirming that you have read, understood and are agreeing to the terms & conditions and cancellation policies outlined below.
Between: You (The Member) and BRIGADE FITNESS UK LTD & BRIGADE FITNESS KINGS HILL LTD (The Gym).
1.0 GENERAL
1.1 All contracts must be paid for in advance. Memberships will not be confirmed until payment has been received.
1.2 I understand there are inherent risks in participating in a programme of strenuous exercise. If I sustain or claim to sustain any injury while participating in the programme, I acknowledge that The Gym and the coaching team are not responsible - except where the injury was caused by gross negligence or by an intentional act of the coach.
1.3 I will adhere to all instructions given to me by The Gym staff.
1.4 I understand my progress is dependent upon my effort, cooperation, consistency and adherence to the programme both inside and outside of the training sessions themselves.
1.5 I understand that opening times are subject to change and will vary from the regular schedule over holiday and Bank Holiday periods.
2.0 CONTRACT DURATION & RENEWAL
2.1 I understand that by completing payment and agreeing this contract I commit myself to a minimum contract term of 3 calendar months.
2.2 I understand that this contract is in force from the contract start date - this commences when payment is successfully processed.
2.3 I understand that once I go past the minimum 3 month term set out in my contract I will automatically enter a rolling monthly contract, where a 60-day notice period is required for cancellation. The 60 day notice period will only start when a cancellation request form is completed and submitted to The Gym. Please see section 5.0.
3.0 PAYMENTS
3.1 The Member agrees to pay monthly recurring fees (as appropriate for the selected membership) for every month’s membership at The Gym via recurring card payment through the Stripe payment system.
Note: This contracted membership allows attendance to either 3 group coaching sessions per week or unlimited group coaching sessions per week (depending on the membership selected), both membership options are restricted to 1 session per day at The Gym. Unused sessions DO NOT carry over from week to week or billing period to billing period.
3.2 I agree to purchase a recurring membership at The Gym as an automatic charge to my credit/debit card every month for a minimum contracted period of 3 months which then automatically enters into a rolling monthly contract unless requested to be cancelled by myself with 60 days notice.
3.3 I hereby certify that I am the holder of the credit/debit card detailed when signing up to this contract via Stripe.
3.4 I understand that my service will be deactivated if my account becomes more than 28 calendar days late.
4.0 MEMBERSHIP PAUSES
4.1 Membership Pauses are not possible during the initial contracted period of 3 months.
4.2 Once the initial contracted period of 3 months has expired and a rolling monthly contract has been entered - Membership Pauses are limited to 60 days (2 payments) per calendar year, in 30-60 day increments only.
4.3 Membership Pause requests will only be approved if there is a medical issue where The Member is unable to attend The Gym, a doctor's note will be required as proof.
4.4 Membership Pause requests will not be approved for holidays or periods of travel with work.
4.5 All Membership Pause requests require 28 days notice before the next scheduled payment date - any requests received later cannot be processed until after the next scheduled payment. A pause request form must be completed and submitted to The Gym, you can do that HERE.
4.6 Upon expiration of any pause period, membership payment will automatically reactivate and resume.
4.7 If you choose to cancel your membership during the pause period you must follow the normal cancellation procedure and the cancellation notice period of 60 days will come into effect. Any payments within that 60 days will be processed as normal and are non-refundable.
5.0 CANCELLATIONS
5.1 Following the initial minimum contracted term of 3 calendar months all membership cancellations are subject to a 60 day notice period - any payments within this 60 day period will be processed as normal and are non-refundable.
Note: You will, of course, be able to continue at The Gym for a month after your final payment has gone through.
5.2 Cancellation of a contract prior to the expiration of the minimum contract term requires an early termination fee equal to 50% of the remainder of the contract.
5.3 There are some exceptions where a contract can be cancelled prior to the expiration date. These are; a change of address > 20 miles from The Gym, where proof of the new address will be required. Illness or injury where a doctor's note will have to be provided. These are the only exceptions.
5.4 Memberships that are paid in full/upfront are non-refundable.
5.5 These terms are NOT flexible so if you don’t intend to adhere to these terms then please DO NOT sign up.
5.6 If you would like to cancel your membership please fill out a membership cancellation form and one of the team will be in touch. You can do that HERE. The 60 day cancellation notice period will only come into effect once a cancellation form has been completed and not under any other circumstances.
6.0 AGREEMENT
6.1 I understand that by completing the terms and conditions form, making payment and taking up membership at The Gym I am entering a contract and agreeing to the terms and conditions outlined above.
